Terms of Service & End User License Agreement (EULA)

By downloading, installing, or using the MenuVista mobile application (the "App"), you agree to be bound by these Terms of Service (the "Agreement"). If you do not agree to these terms, do not use the App.
1. Apple Standard EULA
This Agreement incorporates by reference the Licensed Application End User License Agreement (the "Standard EULA") published by Apple, Inc. (available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/).
To the extent that this Agreement conflicts with the Standard EULA, the terms of this Agreement shall prevail. You acknowledge that this Agreement is concluded between you and Romain Spielmann only, and not with Apple. Apple is not responsible for the App or the content thereof.
2. Description of Service & AI Disclaimer
MenuVista uses Artificial Intelligence (Google Gemini) to analyze images of menus and provide translations, ingredient estimations, and dietary information.
A. No Guarantee of Accuracy
The output provided by the App is generated by AI and is probabilistic in nature. While we strive for accuracy, the App may produce incorrect translations, identify wrong ingredients, or miss specific allergens. You agree that MenuVista is an informational tool only and should not be relied upon as the sole source of truth.
B. Illustrative Images
The App may display photos of dishes alongside the translation. These images are retrieved from third-party search engines (e.g., Google Images, Bing) based on the text name of the dish.
Disclaimer: These images are for illustrative purposes only. They do not represent the actual dish prepared by the specific restaurant you are in. The actual presentation, portion size, and ingredients may vary significantly.
3. Critical Safety & Allergen Disclaimer
THE APP DOES NOT PROVIDE MEDICAL ADVICE.
A. Risk of Error
The App attempts to identify potential allergens (e.g., nuts, gluten, dairy) based on standard culinary recipes. The App cannot detect:
- Specific recipe variations used by the restaurant chef.
- Hidden ingredients not listed on the menu.
- Cross-contamination in the kitchen.
B. User Responsibility
You expressly agree that you assume all risk associated with consuming food ordered based on information from the App.
- YOU MUST ALWAYS VERIFY INGREDIENTS AND ALLERGENS WITH RESTAURANT STAFF.
- Never rely solely on the App if you have a life-threatening allergy.
C. Limitation of Liability for Personal Injury
To the maximum extent permitted by applicable law, Romain Spielmann shall not be liable for any personal injury, allergic reaction, illness, or death resulting from your reliance on the App's analysis, translations, or dietary flags.
4. Privacy & Data Handling
We value your privacy and operate on a "Data Minimization" principle.
- Transient Processing: When you scan a menu, the image is sent to our AI processor (Google Gemini) solely for the purpose of analysis. We do not store, retain, or claim ownership of your menu photos on our servers after the analysis is complete.
- Local Storage: Your scan history and dietary preferences are stored locally on your device.

5. Subscriptions & Payments
A. Plans
MenuVista offers auto-renewing subscriptions (e.g., Weekly, Annual). Pricing is displayed within the App at the time of purchase.
B. Billing
Payment will be charged to your Apple ID or Google Play account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
C. Free Trials
If a free trial is offered, you will be charged the full subscription price automatically at the end of the trial period unless you cancel prior to the end of the trial.
D. Refunds
All billing and refunds are handled directly by Apple or Google. We do not have access to your billing information and cannot issue refunds directly.
6. Limitation of Liability
In no event shall Romain Spielmann be liable for any indirect, special, incidental, or consequential damages related to the use of the App.
7. Third-Party Beneficiary
You and we acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement. Upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.
